MUNICIPALITIES & PREVAILING WAGE
Recently the Pennsylvania Supreme Court upheld an earlier decision by the
Commonwealth Court in Borough of Youngwood vs. Pennsylvania Prevailing Wage
Appeals Board. The Courts ruled that public works projects such as repaving
of roads is considered "maintenance work" and therefore, falls under the
Prevailing Wage Act, requiring municipalities to now pay prevailing wages for
such projects. In March 2007, I introduced
SB 333, which would address this issue by amending the Act to further define
"maintenance work" to include repair work such as replacing guide rails,
pavement repair, and bridge cleaning and resurfacing. Currently, SB 333 remains
on the table in the Senate, having been reported out of the Senate Labor and
Industry Committee.
